We are aware that some customers have recently received cease and desist letters in relation to the use of vehicle images.
Please note that this is an industry wide issue and is relevant to anyone displaying vehicle images on their website. The company issuing these cease and desist letters appears to be conducting an industry-wide campaign, regardless of the image supplier.
We have spoken directly with the BVRLA about this issue who have advised that they will be issuing a communication to all Leasing Broker Members shortly. In the meantime, they have provided the following guidance:
In the event that you receive a cease and desist letter, your response should include the following points:
- Request the nature of the proposed breach and the trade in which the owner is engaged in
- Request the details of the copyright owner and evidence of this claim
- Withhold your right to object to the claim provided until sufficient evidence is shown
- Do not share any personal, company, or payment details unless you have independently verified the legitimacy of the request.
